Bid/ask analysis filter problem

I am trying to add two analysis to my 1 minute chart. I would like to be able to track trades <=39 in one, and trades >39 in another.

The filter is not allowing me to use the <>. It totally ignores the filter value and gives just the overall total when the <> is used.
